In Conversation With Harsh Gupta on His Litigation & Corporate Law Experience & Evolving Challenges

Harsh Gupta is a 2020 law graduate from Hidayatullah National Law University, Raipur. To specialise in commercial and company law(s), he completed his post graduation in CS from Institute of Company Secretary of India in November 2021 and is also a licentiate member of ICSI. Being inclined towards litigation, Harsh enrolled himself with the bar and joined Pransh Law Offices, Raipur in February 2022 and has been working with the firm since then. He has been handling matters relating to Arbitration, Commercial & Company law(s), Consumer Laws and MSME. He currently co-heads Pransh Law offices in Bhilai.

1. What inspired you to pursue a career in law, and what has been your journey so far?

Harsh: “The law has always captivated me as a framework that structures and guides human relationships. The opportunity to delve into complex legal issues, construct compelling arguments, and ultimately, secure justice for my clients is incredibly fulfilling. The journey to becoming an advocate is undoubtedly challenging, requiring years of dedicated study and rigorous preparation. However, the privilege of standing up for the rights of others and contributing to the legal system is a constant source of inspiration.

Glimpse into my journey – Within one year of completion of my graduation in BA.LLB (Hons.), I became a Licentiate Company Secretary. Thereafter, I joined Pransh Law Offices at Raipur where I continue to practice.” As I honed my skills and experience in commercial litigation and arbitration at Pransh Law Offices, I was fortunate to be entrusted with leading the Bhilai office. It’s an honor to spearhead this branch and continue providing our clients with the quality legal representation that Pransh Law Offices is known for.”

2. You specialize in Arbitration, Commercial Laws, MSME, and Consumer Laws. How do you define your expertise in these areas?

Harsh: “My expertise in these areas is rooted in a deep understanding of the complex interplay between legal principles and business realities. In Arbitration, I focus on crafting effective dispute resolution strategies, representing clients diligently in arbitral proceedings, and ensuring the enforcement of favorable awards. My proficiency in Commercial Laws empowers me to navigate intricate contractual relationships, corporate governance, and regulatory compliance, providing strategic counsel to businesses of all sizes. With a keen understanding of the Consumer Rights and MSME sector, I offer tailored legal solutions to protect client’s interests, from contract drafting and negotiation to dispute resolution and recovery of dues.”

3. How many years have you been practicing law for, and what have been some of your key experiences?

Harsh: In the past three years, I’ve established myself as a practicing advocate with a strong focus on commercial litigation and arbitration. These areas perfectly align with my interest in complex legal matters and high-stakes client representation. Each case presents a unique opportunity to leverage my skills and achieve successful outcomes.

One key experience was successfully representing a client in a complex Arbitration dispute. Through meticulous research, I uncovered a crucial clause that ultimately strengthened our case and led to a favorable settlement for the client. Effectively presenting clients’ arguments and finding common ground with the opposing party not only sharpened my negotiation skills as a lawyer but also put me in the leadership seat to impact the destiny of my client’s case.

4. What is your typical approach to preparing for a litigation case?

Harsh: I begin by establishing a deep understanding of the case through meticulous fact-gathering and legal research. This comprehensive foundation enables me to develop a robust case strategy tailored to my client’s specific goals. I meticulously analyze evidence, prepare witnesses, and anticipate potential counterarguments. Throughout the process, I maintain open communication with my client, ensuring their active involvement in decision-making. By combining strategic thinking with a thorough knowledge of the law, I strive to build a strong case that effectively advocates for my client’s interests.

5. How do you maintain effective communication with your clients throughout the litigation process?

Harsh: “Maintaining clear and consistent communication with my clients throughout the litigation process is paramount. Here’s my approach:

  • Establishing Clear Expectations:  At the outset, I discuss the litigation process in detail, outlining potential timelines, milestones, and costs. This transparency sets realistic expectations and fosters trust.
  • Regular Updates: I keep clients informed with regular updates,  tailored to their preferred method (email, phone calls, meetings).  These updates  briefly explain developments, next steps, and any necessary actions on their part.
  • Accessibility and Responsiveness:  I prioritize client accessibility and aim to promptly respond to inquiries. Even if I can’t provide a detailed answer immediately, I acknowledge their message and give a timeframe for a more comprehensive response. This demonstrates my commitment to being available and responsive to their concerns.
  • Proactive Communication:  I don’t wait for questions – I anticipate concerns and proactively address them in updates or discussions.  This minimizes confusion and anxiety for the client.
  • Plain Language:  I avoid legalese and complex jargon, explaining legal concepts in clear and concise terms. This ensures my clients understand the situation and can actively participate in decision-making.
  • Open Dialogue:  I encourage open dialogue with my clients. This allows me to fully understand their perspectives and concerns, leading to better informed strategies and a stronger attorney-client relationship.”

 

6. How do you stay updated with the latest developments in your field of expertise?

Harsh: Staying abreast of the latest developments in commercial litigation and arbitration is crucial for providing clients with the best possible representation. Here are some key strategies I use:

  • Landmark Judgments: I prioritize studying recent landmark judgments from the Supreme Court and High Courts relevant to commercial disputes and arbitration. This keeps me informed of evolving legal interpretations and precedents.
  • Industry Publications & Legal Journals: I subscribe to respected Indian legal journals like the Journal of the Indian Law Institute (JILI) or the Supreme Court Cases (SCC) focusing on commercial law and arbitration. These provide in-depth analysis by leading Indian legal scholars and practitioners.
  • Industry Seminars & Conferences: I actively participate in seminars and conferences relating to legal education and developments. These events offer valuable insights from legal luminaries and foster networking opportunities with peers.
  • Online Legal Research Platforms: Legal research databases like Manupatra or SCC Online serve as crucial resources for staying current on Indian case law, statutes, and amendments impacting commercial disputes.
  • Following Legal Experts: I follow prominent Indian legal professionals and thought leaders specializing in commercial litigation and arbitration. This can involve engaging with their blogs, social media discussions, or attending webinars they conduct.

7. What are your professional goals for the next five years?

Harsh: “In the next five years, I aim to solidify our position as a leading law firm in Arbitration and Commercial Laws and Litigation. I aspire to expand my expertise through continuous learning and specialization, particularly in emerging areas of these domains. Building strong client relationships and delivering exceptional outcomes will remain my primary focus. I envision myself taking on more complex and high-stakes cases, while actively contributing to the legal community through publications, conferences, and mentorship. Ultimately, I aspire to establish a reputation for excellence and integrity, positioning myself as a trusted advisor to businesses and individuals alike.”

8. How do you foresee the field of litigation evolving, and how are you preparing for these changes?

Harsh: “The legal landscape is undergoing a rapid transformation, driven by technological advancements, evolving societal norms, and economic shifts. I anticipate an increased emphasis on alternative dispute resolution, the growing influence of artificial intelligence in legal research and analysis, and a heightened focus on cybercrime and data privacy. To prepare for these changes, I am actively investing in developing digital literacy and legal tech skills. I am also closely monitoring legislative developments and case law to stay updated on emerging legal trends. Additionally, I believe that building strong client relationships based on trust and transparency will be crucial in the evolving legal ecosystem. By embracing these changes and adapting my practice accordingly, I aim to provide innovative and effective legal solutions to my clients.”
